1. About Us
These Terms govern the use of the website kinetix.digital and all services provided by Kinetix Digital (“Kinetix”, “we”, “us”). By using the website, submitting an application or working with us, you (“Partner”, “you”) accept these Terms.
2. Our Services
Kinetix is a data-driven performance marketing agency. We provide media buying, analytics, campaign optimization, retention and affiliate partnership services across multiple digital verticals, including:
- Crypto & Trading
- Financial Services & FinTech
- SaaS & AI Tools
- iGaming & Entertainment
- Dating & Social Discovery
- Nutra & Wellness
We may add or remove verticals, offers and GEOs at our discretion. Specific scope, budgets and KPIs for each client or campaign are set out in a separate agreement or insertion order (IO), which prevails over these Terms in case of conflict.
3. Affiliate Program
3.1 Eligibility. Participation is subject to our approval. We may reject or remove any Partner at our sole discretion.
3.2 Commission models. Depending on the offer, vertical and GEO, commissions may be paid on a:
- CPA — a fixed fee per Qualified Customer;
- RevShare — a percentage of Net Revenue generated by referred customers for the lifetime of their account;
- Hybrid — a combination of CPA and RevShare.
Rates shown on the website (“from”, “up to”) are indicative. Final rates, qualification criteria and payment terms are agreed individually per offer.
3.3 Qualified Customer means a new, unique customer referred via your tracking link who completes the action agreed for the relevant offer (e.g. registration, deposit, purchase, subscription) and meets the offer’s criteria.
3.4 Tracking. Our tracking system is the sole basis for calculating commissions.
3.5 Payments. Commissions are paid monthly. You are responsible for your own taxes. We may hold payments pending a fraud review.
4. Traffic Rules and Compliance
4.1 You must comply with all laws, regulations and advertising rules applicable to each vertical and GEO you promote, including gambling, financial promotion, crypto-asset, consumer protection, health claims and data protection rules, as well as platform policies (Google, Meta, TikTok, etc.).
4.2 Prohibited: fraudulent, incentivized or bot traffic, cookie stuffing, brand bidding without written consent, spam, misleading claims (e.g. guaranteed profits, unapproved health or medical claims), targeting minors or vulnerable persons, promotion in restricted GEOs, and any traffic not approved for the specific offer.
4.3 iGaming and trading offers must be promoted to persons of legal age only (18+ or higher where required), with responsible gambling or risk warnings where required.
4.4 Breach of this section entitles us to withhold or reverse commissions for affected traffic, suspend campaigns and terminate cooperation immediately.
5. Intellectual Property
All website content, trademarks and creatives we provide remain the property of Kinetix or its advertisers. You may use them only for approved campaigns and must stop using them on termination.
6. Confidentiality
Both parties must keep confidential all non-public information (rates, data, performance results, advertiser details) received during cooperation, during the cooperation and for 2 years afterwards.
7. Data Protection
Each party processes personal data in accordance with applicable data protection laws, including the GDPR where it applies. See our Privacy Policy for details.
8. Liability
Services and the website are provided “as is”. We do not guarantee any specific results, traffic volume or earnings. To the extent permitted by law, our total liability is limited to the commissions or fees paid to or by you in the 3 months preceding the claim, and we are not liable for indirect or consequential losses.
9. Termination
Either party may terminate cooperation at any time with written notice. Commissions validly earned before termination will be paid, except where termination results from a breach of these Terms.
10. Changes
We may update these Terms at any time. The current version is always published on the website. Continued use means acceptance.
